As the court said in its ruling, both the disputing parties have to present their oral arguments on February 8. According to the Wall Street Journal, a ruling could come “days or weeks” after that hearing. The court heard Trump's appeal and will decide whether the former president can run for president.
December 19 Colorado Supreme Court Trump was ruled ineligible for the presidency on January 6, 2021 — because he was involved in an “uprising” that the court deemed prompted his supporters to blockade the Capitol. The court agreed with a group of voters who filed a petition to disqualify Trump from the election, citing the 14th Amendment to the US Constitution, which was established after the Civil War.
The former president's attorneys appealed the ruling, arguing that the Colorado court did not have the authority to deny Trump's candidacy. They also argued that Congress, not state courts, had the right to decide who was eligible for the presidency. They argued that Trump did not engage in sedition and that the President of the United States is not an “officer” and does not hold an “office” within the meaning of the 14th Amendment. According to the Washington Post, most legal scholars expect the US Supreme Court to decide whether to put Trump's name on the ballot, while seeking to avoid the question of whether his actions on January 6 were sedition or participation in sedition.
Trump's problems in other states too
Although a potential ruling by the U.S. Supreme Court will likely refer to the Colorado court's decision, it will apply and affect elections in all states. Authorities and courts in various states have so far issued conflicting decisions on the matter. As in Colorado, Trump was disqualified from the Republican primary in Maine (he appealed the decision to a state court).
In turn, the Supreme Courts in Michigan and Minnesota ruled that they did not have the authority to remove Trump from the voter rolls. Petitions have been filed in various states to disqualify Trump. In practice, these decisions are on hold until the case is resolved by the US Supreme Court.
Iowa's first Republican primaries will be held on January 15. Those in Colorado, like most states, are held in March. Trump is the clear favorite to win the party's Republican nomination for the November election.
